These terms govern your use of the services provided by Agentic Builds ("we", "us"), reachable at hello@agenticbuilds.ie. By placing an order you agree to these terms together with our Privacy Policy and Refund Policy.
1. Services
We design and build custom websites for small and medium Irish businesses, and optionally provide ongoing maintenance and hosting through a monthly subscription ("Premium maintenance").
2. Orders and acceptance
An order is formed when payment is taken via our checkout. We will send a confirmation email and a project intake form. We may decline or refund an order at our discretion (for example if the brief falls outside our scope or appears fraudulent).
3. Express consent to begin work
Our services are bespoke digital services. By completing checkout you expressly request that we begin work immediately and you acknowledge that, in doing so, you lose the 14-day cancellation right that would otherwise apply to distance contracts under EU consumer law (S.I. 484/2013 / Directive 2011/83/EU). Refunds after work begins are governed by our Refund Policy.
4. Your responsibilities
- Provide accurate brief details, content (copy, images, brand assets) and approvals in a reasonable timeframe.
- Ensure you own — or have permission to use — anything you supply. You indemnify us against third-party IP claims arising from material you provide.
- Respond to review requests within 14 days. Prolonged inactivity (over 30 days) may pause a project and require a restart fee.
5. Timelines
Turnaround estimates shown on our pricing page are good-faith targets, not guarantees. We are not liable for delays caused by missing content, late approvals, or third-party services (domains, payment processors, etc.).
6. Revisions
Each package includes the revision rounds described at purchase. Additional rounds or significant scope changes are quoted separately at our standard hourly rate.
7. Intellectual property
On receipt of full payment, ownership of the bespoke design and content created specifically for you transfers to you. Third-party elements (fonts, stock imagery, open-source code, plugins) remain under their own licences. We retain the right to display the project in our portfolio and case studies unless you ask us in writing not to.
8. Maintenance subscriptions
- Billed monthly via Stripe. Cancel any time from the billing portal.
- Cancellation takes effect at the end of the current paid period; there are no pro-rata refunds for the current month.
- The Premium maintenance plan includes hosting on our infrastructure. If you cancel Premium maintenance, your live site will be paused until you migrate it elsewhere or resubscribe. We will provide an export on request.
9. Acceptable use
You may not use our services to host illegal, defamatory, hateful, adult, or malicious content, or to send spam. Breach may result in immediate suspension without refund.
10. Warranty
We provide our services with reasonable skill and care. Where applicable, your statutory rights as a consumer under Irish law are not affected by these terms.
11. Limitation of liability
Nothing in these terms limits liability for death or personal injury caused by our negligence, fraud, or any liability that cannot be excluded under Irish law. Subject to that, our total aggregate liability to you arising out of or in connection with the services is limited to the fees you have paid us in the 12 months preceding the event giving rise to the claim. We are not liable for indirect or consequential losses, loss of profit, loss of revenue, loss of data or loss of business opportunity.
12. Suspension & termination
We may suspend or terminate services for non-payment, breach of these terms, or unlawful activity. You may cancel subscriptions at any time as described above.
13. Changes
We may update these terms occasionally. The version in force is the one published on this page on the date of your order.
14. Governing law
These terms are governed by the laws of Ireland. Any disputes will be subject to the exclusive jurisdiction of the Irish courts.
